2. Personal information we process

SPARQUE B.V. processes your personal information because you use our services and/or because you provide it to us yourself. If you leave comments on the site, we collect the data shown in the comment form.

2.1. Special and/or sensitive personal data that we process

Our website or service does not intend to collect data about website visitors who are under the age of 16, unless they have permission from their parents or guardians. However, we cannot check whether a visitor is over the age of 16. We therefore recommend that parents are involved in their children's online activities to prevent data about children being collected without parental consent. If you believe that we have collected personal data about a minor without such consent, please contact us at info@sparque.ai and we will delete this data.

 

2.2. For what purposes and on the basis of which grounds do we process personal data?

SPARQUE B.V. processes your personal data for the following purposes:

Your personal data is processed in order to provide you with the requested services. This includes all necessary steps to fulfil our service obligations, including communicating with you, managing your account and processing payments. The legal basis for this processing is the fulfilment of a contract pursuant to Art. 6 para. 1 lit. b GDPR.

We analyze your behavior on our website in order to continuously improve it and offer you products and services that match your preferences and interests. This analysis helps us to optimize the user-friendliness of our website and to make personalized recommendations. The legal basis for this processing is our legitimate interest pursuant to Art. 6 para. 1 lit. a GDPR to ensure that our website is user-friendly and provides relevant content and offers.

a) When you make an inquire by email

If you have questions about our products or services, we offer you the opportunity to contact our customer service (by telephone or e-mail) in accordance with Art. 6 para. 1 lit. a) GDPR. The disclosure of your personal data to us is always voluntary. The purpose of collecting your personal data (title, first name, surname, company email address, company name) is to identify you and respond to your enquiry. All personal data that you provide to us in an enquiry by e-mail will be automatically deleted after 24 months, unless longer statutory retention periods apply.

b) Data processing for direct marketing

Data processing takes place on the basis of your consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR, provided that you have given your consent for direct marketing. We store your e-mail address for sending product information by e-mail or your telephone number in order to use it to contact you. We also use various data to provide you with information that is as personalized as possible: Receipt and read confirmations of e-mails, date and time of your visit to our website, products you have viewed. You can revoke your consent at any time by sending us a corresponding message to info@sparque.ai. All personal data that we process for the purpose of direct marketing will be stored until consent is withdrawn and in accordance with the legal requirements. The data will be stored until receipt of the objection and in compliance with the statutory provisions. Any interests that are particularly worthy of protection do not prevail, as it is possible to object to data processing and delete the data at any time.

c) How long do we store personal information?

SPARQUE B.V. only stores your personal data for as long as is strictly necessary to fulfil the purposes for which your data was collected.

d) Sharing personal information with third parties

SPARQUE B.V. only shares personal data with third parties if this is necessary for the execution of our agreement with you or to fulfil legal obligations.

e) Data transfer outside the European Economic Area

We store your data as much as possible in the European Economic Area (‘EEA’). Occasionally, some of the data we collect may be transferred to, or stored at, a destination outside the EEA, for example because one of our third party service providers is based there. When this happens, we ensure that it is done in a secure and lawful manner. This means that Sparque B.V. then chooses, as far as possible, parties based in countries that have a similar level of protection as in Europe. The European Commission (EC) decides which countries fulfil this requirement by means of a so-called ‘adequacy decision’. For example, the Commission has decided that organizations based in the United States that participate in the Data Privacy Framework offer at least a good level of data protection. Some of the parties that Sparque B.V. works with are based in the United States and participate in this framework.

 

3. Cookies or other similar technologies we use

SPARQUE B.V. only uses technical, functional and analytical cookies that do not infringe your privacy. A cookie is a small text file that is stored on your computer, tablet or smartphone when you visit this website for the first time. The cookies we use are necessary for the technical operation of the website and your convenience. They ensure that the website works properly and save your preferences, for example. Our interest here is the economic necessity of being able to contact potential new customers. Leadfeeder is contractually obliged to use and store your personal data in accordance with European data protection standards, strictly in accordance with instructions, not for its own purposes and in compliance with the relevant security standards. Leadfeeder records the visitor's IP address in order to determine the company and geographical location. The personal data is automatically deleted in Leadfeeder after 24 months. c) Hotjar

To improve the user experience on our websites, we use Hotjar, which is essentially a web analytics service based on tracking code provided by Hotjar Ltd (‘Hotjar’) (https://www.hotjar.com, Level 2, St Julian's Business Centre, 3, Elia Zammit Street, St Julian's STJ 1000, Malta, Europe). The data processing takes place on the basis of your consent in accordance with Article 6 (1) point (a) GDPR if you have given your consent via our cookie banner. Hotjar makes it possible to measure and evaluate user behavior (clicks, mouse movements, scroll heights, etc.) on our website. Hotjar uses so-called ‘cookies’, which are text files that are stored on your computer and which enable your use of the website to be analyzed. IP addresses are only stored and processed in anonymized form in order to exclude any direct personal reference. Our website uses the “LinkedIn” button of the social network LinkedIn, which is operated by LinkedIn Ireland Unlimited Company, Attn: Legal Dept. Data processing is carried out on the basis of your consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR or § 25 para. 1 TDDDG, provided that you have given your consent via our cookie banner. The “LinkedIn” button can be recognized by the blue “in”. If you activate the plug-in on one of our websites by clicking on it, the browser will establish a direct connection to the LinkedIn servers. e) Google Tag Manager

Our website uses “Google Tag Manager”, which is provided by “Google” (Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland, fax: +353 (1) 436 1001). “Google Tag Manager” is a solution that allows website tags and other elements to be managed through a single interface.

When you visit the website with ‘Google Tag Manager’, an HTTP request is first sent to ‘Google’.
This transmits device information and personal data - such as your IP address and information about your browser settings - to Google. We use ‘Google Tag Manager’ to facilitate electronic communication by providing information to third-party providers, including via programming interfaces. The legal basis for this processing is Article 6 (1) point (a) GDPR. The ‘Google Tag Manager’ does not initiate any data storage. On the other hand, the ‘Google Tag Manager’ integrates tags from third-party providers, such as tracking codes or tracking pixels, on our website. The tool triggers other tags, which in turn collect your data; this is explained separately in our privacy policy. The ‘Google Tag Manager’ itself does not analyze the device information and personal user data collected by the tags. Rather, your data is forwarded to the respective third-party service for the purposes specified in our consent management tool. We have configured ‘Google Tag Manager’ to work with our consent management tool so that the triggering of certain third-party services in ‘Google Tag Manager’ depends on the selections you make in our consent management tool, so that only the third-party tags for which you have given consent trigger data processing. The use of ‘Google Tag Manager’ is subject to your consent for the respective third-party service. The legal basis for this processing is your consent in accordance with Article 6 (1) point (a) GDPR. Data processing by Google Tag Manager may take place outside the EU or the EEA (in particular in the USA). An adequate level of data protection is guaranteed for this data transfer on the basis of the adequacy decision (EU-U.S. Data Privacy Framework). You can withdraw your consent to the processing and transfers to third countries at any time by moving the slider back for the respective third-party provider in the consent tool “Settings”. This does not affect the lawfulness of the processing carried out on the basis of the consent prior to the withdrawal.

  • the right to lodge a complaint with a supervisory authority pursuant to Art. 77 GDPR.

5. How we protect personal information

SPARQUE B.V. takes the protection of your personal data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure and unauthorized modification. 6. Consent-Management-Plattform Contao Consent (hofff/contao-consent)

To make it easier for us to ask for your consent to the use of cookies or other tracking technologies so that we can process your device information and personal data when you visit our website, we use the consent tool “Contao Consent” (hofff/contao-consent). “Contao Consent” gives you the opportunity to accept or decline the processing of your device information and personal data using cookies or other tracking technologies for the purposes listed in the “Contao Consent” tool.
